Restrictions on 3web Local Phone 9-1-1 Calling

On this web page "we", "us", or "our" refers to 3web Corp. together with all of its subsidiaries and "you" and "your" refer not only to you, but also include every person you authorize to act as your agent with regard to 3web Local Phone service through one or more accounts we have designated and provided to you.

We offer access to emergency services through 9-1-1 calling. We provide E9-1-1 access with automatic call back number and location information to the same emergency call centers you would access today using your traditional phone service. A 9-1-1 operator will receive your phone number and location information automatically. But there are some additional things you need to know which are described below.

3web Local Phone service may not be available during a power outage and will not be available during a broadband Internet service outage. In order to reduce the chance that 9-1-1 calling will be unavailable during a power outage you must ensure that all of the equipment used to provide your 3web Local Phone service is connected to your electrical outlet through an uninterruptible power supply (hereinafter called “UPS”). The UPS is designed to keep your 3web Local Phone service running up to several hours or until your power returns. The rechargeable battery inside the UPS should be replaced with a new one at least once a year so that the UPS can maintain a maximum charge in the event of a power outage.

Although some of our competitors support a nomadic service which allows you to use your broadband phone equipment from anywhere in the world to make calls, 3web does NOT support this feature and considers you in breach of your End-User Service (available at http://www.3web.com/Legal/End-User_Services_Agreement) if you attempt to use the service that way. You are required to use your 3web Local Phone service at home to ensure that your proper location information is sent to emergency call centers in the event you need to use 9-1-1 dialing. If this requirement is not followed, your 9-1-1 service will not work properly.

Whenever your 3web Local Phone service must be moved, unless a self-install option for the service is permitted by us, you must schedule an appointment for us to move any equipment required in connection with the service to be moved, other than equipment, such as, without limitation, your computer system, for which you are solely responsible. If self-installation is allowed, you must call us when moving your 3web Local Phone service so that we may update your location information for 9-1-1 calling purposes.

Should you not properly install equipment provided by or through us or maintain its proper installation configuration where a self-installation option is permitted or should you tamper with the equipment or the installation of any of the equipment provided by or through us to deliver 3web Local Phone or high speed Internet, your 911 service may not be available.

You are required to make all other potential users of your 3web Local Phone service aware of these limitations relating to 9-1-1 calling.

WE, OUR AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, UNDERLYING CARRIERS AND OTHER THIRD PARTY SUPPLIERS WILL NOT BE LIABLE FOR ANY INJURY, DEATH OR DAMAGE TO PERSONS OR PROPERTY, ARISING DIRECTLY OR INDIRECTLY OUT OF, OR RELATING IN ANY WAY TO THE PROVISION OF 9-1-1 SERVICE AND/OR EMERGENCY 9-1-1 BY US, INCLUDING WITHOUT LIMITATION ANY INABILITY ON YOUR PART TO ACCESS 9-1-1 SERVICE AND/OR EMERGENCY 9-1-1 IN THE EVENT OF A SERVICE DISRUPTION FOR ANY REASON WHATSOEVER.
